Section 18
Extraordinary family pension and gratuity

(1) If a judge dies immediately due to an accident in the course of his official work or if he dies later without recovery due to the same, his widow wife or widower husband will be given a separate lifetime monthly family pension as follows and in addition to that as follows Paters will be subscribed: Patke Upadan
(a) High Court Judge Rupees Two Hundred and Fifty Rupees Eight Thousand Seven Hundred and Fifty Rupees (b) Judge of District Court Rupees One Hundred Ninety Five Rupees Six Thousand Five Hundred Rs.It will be recognized only in the following cases:-

(a) Married to the judge before his death,

(b) Living with the judge at the time of his death.

(3) If there is no widowed wife, or if she has separated from her husband before his death, or if the widowed wife has remarried, the child born of the widowed wife can be given a lump sum by the damasahi according to sub-section (1). For this purpose, the government of Nepal may also provide family allowance at a reasonable rate not exceeding two-thirds of the number of family allowance received by the widowed wife for the period it sees fit. If the mother, father or mother-in-law, father-in-law are both or one of the two, for the purpose of their livelihood, the government of Nepal can provide family allowance at a reasonable rate so that the amount of family allowance received by the widowed wife or widower husband does not increase to two-thirds for the period it deems appropriate.

(5) If there is no widow, child or mother, father or mother-in-law, in-law of the deceased judge and if any of the dependent brothers or unmarried sisters of such judge remain, for the purpose of their maintenance, for the period deemed necessary by the Government of Nepal, two of the points of the family status will be given to the widowed wife or widowed husband by Damasahi. The family will be able to provide a reasonable amount not to exceed one-third.
